
To receive the full 30 day money back guarantee, you must cancel your account within 30 days of your account being set up. Please follow the cancellation procedures as outlined in our service agreement.
If you want a full refund of setup fees and monthly fees (domain registration and processing fees can not be refunded) based on our 30 day satisfaction guarantee, just include in your cancellation request that you were unsatisfied, your reasons for dissastisfaction, and that you would like a full refund. If you do not include this information we will assume that you were satisfied with our service, are cancelling for a reason other than dissatisfaction, and you will only receive the typical prorated refund on your monthly fees.
All requests for cancellation based on dissatisfaction must be immediate. You can not request for your account to be canceled on a date in the future and receive a full refund.
bitServe will refund the customer's monthly fee in the event of a service outage due to the failure of one of the following bitServe-operated pieces of equipment; the ATM Network, the LAN, or core router. For purposes of this guarantee, service outages shall be defined as 10 consecutive minutes or a total of more than 30 minutes within one calendar month of web site (HTTP) inaccessibility.
bitServe will not be held responsible for service outages resulting from non-bitServe operated equipment including, but not limited to, Internet NAP failures or congestion (MAE East, MAE West, etc.) and non-bitServe backbone failures. Additionally, bitServe will not be held responsible for outages resulting from malfunctioning customer scripts or applications that are installed by the customer, nor for unusual traffic spikes or "denial of service" attacks on customer web sites. Hardware sometimes fails, and should the web server that hosts your web site fail for any reason, we will not be held responsible but will restore the machine back to working order as fast as possible and attempt to restore all data to its original state.
Refunds will be issued upon request by the customer and upon determination that a service outage, as defined by this guarantee, has occurred. Refund requests must be made within thirty (30) days of the issuance of the invoice that represents the time period during which the service outage took place. Regardless of the number of outages, all refunds are limited to one month's hosting service fees and do not include excess usage fees, setup fees or other non-standard recurring charges. Additionally, service outages will not include downtime due to Acts of God, nor for outside security breaches. Finally, bitServe will not be held liable for service outage damages resulting in the loss of prospective profits or anticipated sales or as a result of expenditures, investments, or commitments in connection with the business.
